VAT on fuel and entertainment in South Africa

Both categories can be business expenses, but their VAT treatment is not the same as an ordinary standard-rated purchase.

What is the short answer?

Specified fuel levy goods—including common petrol and diesel products—are generally zero-rated, so the fuel price ordinarily contains no VAT amount to deduct as input tax. Entertainment is commonly standard-rated, but the VAT Act generally denies the recipient’s input-tax deduction on entertainment expenses, subject to specific exceptions.

Fuel: zero-rated does not mean “claim the VAT back”

A zero-rated supply is still a taxable supply, but VAT is charged at 0%. SARS lists fuel levy goods such as petrol and diesel among zero-rated supplies. If no VAT was charged on the fuel, there is no fuel input-VAT amount to recover.

A service-station receipt may also include oil, food, car-wash services or other standard-rated items. Those lines must be reviewed separately rather than applying the fuel result to the entire slip.

Entertainment: a specific input-tax denial

SARS’s VAT 404 Guide explains that input tax is denied on goods or services acquired for entertainment even when the expense is incurred in carrying on an enterprise, subject to stated exceptions. Examples include many business lunches, client hospitality, staff functions and entertainment events.

This is not a blanket rule that every entertainment expense is irrelevant for income tax. VAT and income tax are separate analyses. A genuine business expense may still require income-tax consideration even though its input VAT is denied.

Evidence still matters

Keep the original slip, identify the business purpose and record any mixed or private use. For vehicle-related deductions, appropriate travel and expense records may also be relevant. The correct income-tax outcome depends on the taxpayer and facts, not only the merchant category.
